1. Acceptance of Terms
Welcome to the Vakil Patient Mobile App Hub. These Terms and Conditions of Use ("Terms") govern your access to and use of our mobile applications, web portals, APIs, and online clinic booking software services.
Please read these Terms carefully before downloading or using the App. By registering an account, booking appointments, or executing transactions on our platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use or download our applications.
2. App Access, Registrations & Accounts
To use the Vakil Patient Mobile App, you must register a patient profile:
- Account Responsibility: You are responsible for preserving the confidentiality of your verification pins, login tokens, and access credentials. Sharing accounts or bypassing verification points constitutes an operational violation and may result in immediate suspension.
- Accurate Information: You hold full responsibility for the registration details (Phone numbers and Health Files) submitted via active portal sessions.
3. Medical Disclaimer (Critical Notice)
NOT AN EMERGENCY RESPONSE TOOL
Vakil Health Care is NOT a replacement for emergency medical services. In the event of an immediate medical emergency, please contact your local emergency services (such as 102/112 in India, 911 in the United States, or local ambulance services) or proceed to the nearest emergency ward.
The services, diagnostic tracking tools, and records presented in the Vakil Patient App serve strictly as administrative tracking utilities for health parameters. We do not provide direct medical diagnostics, clinical interpretations, or professional treatment advice. Any diagnostic calculations or vitals metrics compiled by the App are for tracking reference only and must be verified by a qualified medical practitioner.
4. Payments, Billing & Cancellation Policy
Our platform allows you to book clinic consultations and settle pharmacy co-pays online. All transactions are governed by the following billing rules:
Online Transactions
Payments are processed securely via leading PCI-DSS compliant third-party gateways (e.g., Stripe, Razorpay). You agree to pay all charges incurred under your account at the rates in effect when the charges were incurred.
Cancellation & Refund Policy
All bookings, payments, and transactions completed through our platform are final and strictly non-refundable. Please note:
- No Cancellations: Once an appointment, consultation slot, or pharmacy order is booked and paid for, it cannot be cancelled or rescheduled for a refund.
- No Refunds: We do not operate a refund system. No refunds will be provided for unused bookings, cancellations, or user no-shows under any circumstances.
In the event of a technical billing error where a transaction fails but funds are debited from your account, the debited amount will be auto-refunded to your original payment source by the payment processor within 5 to 7 business days.
5. Mobile App Store Requirements (Apple & Google Play)
When downloading the Vakil Patient App via the Apple App Store or Google Play Store, you acknowledge and agree that:
- These Terms are concluded solely between you and Vakil Health Care Systems, and not with Apple Inc. or Google LLC. We are solely responsible for the App and its content.
- We grant you a non-transferable license to use the App on any mobile device you own or control, in accordance with the Usage Rules set forth in the respective App Store Terms of Service.
- Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Vakil Health Care, and not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You must comply with all applicable third-party terms of agreement when using the App.
6. Acceptable Conduct & Prohibited Actions
As a condition of using the platform, you agree not to:
- Submit false, misleading, or fraudulent patient files or biometric inputs.
- Decompile, reverse-engineer, or attempt to extract the source code of the App.
- Bypass or disable any security features, authentication tokens, or digital locks.
- Scrape data, send automated bot queries, or flood the booking server with traffic.
7. Limitation of Liability & Warranty Disclaimers
The platform is provided "as is" and "as available". Although we maintain real-time replication clusters to guarantee maximum system uptime, we do not assure interrupt-free service during maintenance cycles or localized networking outages.
In no event shall Vakil Health Care, its directors, or its partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of clinical data, loss of profits, or health complications arising out of your inability to access or use the App, even if we were informed of the possibility of such damages.
8. Governing Law & Dispute Resolution
These Terms shall be governed, construed, and enforced in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of the use of our applications or website shall first be submitted to direct resolution panels or amicable arbitration. If arbitration fails, disputes shall be submitted to the exclusive jurisdiction of the state courts located in Azamgarh, Uttar Pradesh, India.
